“Mobile Claim-it” Acceptable Use Policy
1.0 Introduction
This Acceptable Use Policy (“Policy”) sets forth the general guidelines, acceptable and prohibited use of the “NHIS Mobile Claim-it Application (NMCA) or Service” herein referred to as (Mobile Application and Services) and any of its related products and services. This Policy is a legally binding agreement between you the user and this Mobile Application Owner (National Health Insurance Authority- NHIA). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “You” or “Your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Mobile Application and Services. By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this agreement. You acknowledge that this agreement is a contract between you and the NHIA, even though it is electronic and is not physically signed by you, and it governs your use of the Mobile Application and Services.

By using the Application, you acknowledge and explicitly agree that NHIA may disclose certain information to Service providers who help us provide the Services such as payment gateways, process credit or debit card payments and provide analytics and web hosting services.
By using the Application, you acknowledge and explicitly agree that NHIA may disclose certain information to providers that build profiles to improve the diagnostic capabilities of the Application. NHIA will not share your information without your permission.
By using the Application, you acknowledge and explicitly agree that, with your permission, NHIA will share some health-related information, with third party devices and services, such as NHIA Health Providers. If you connect your NHIA accounts to a third-party device or service, such as Apple Health or Google Health, may be asked to share your information with that application. NHIA will not share your information without your permission.
3.0 Prohibited activities and uses
You may not use the Mobile Application and Services to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject NHIA to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this Policy:

Any User in violation of the Mobile Application and Services security is subject to criminal and civil liability, as well as immediate account termination. Examples include, but are not limited to the following:

You may not consume excessive amounts of the resources of the Mobile Application and Services or use the Mobile Application and Services in any way which results in performance issues or which interrupts the Services for other Users. Prohibited activities that contribute to excessive use, include without limitation:
3.3 No spam policy
You may not use the Mobile Application and Services to send spam or bulk unsolicited messages. NHIA maintains a zero-tolerance policy for use of the Mobile Application and Services in any manner associated with the transmission, distribution, or delivery of any bulk e-mail, including unsolicited bulk or unsolicited commercial e-mail, or the sending, assisting, or commissioning the transmission of commercial e-mail that does not comply with the U.S. CAN-SPAM Act of 2003 (“SPAM”).
3.4 Defamation and objectionable content
NHIA values the freedom of expression and encourage Users to be respectful with the content they post. NHIA is not a publisher of User content and are not in any position to investigate the veracity of individual defamation claims or to determine whether certain material, which NHIA may find objectionable, should be censored. However, NHIA reserves the right to moderate, disable or remove any content to prevent harm to others or to us or the Mobile Application and Services, as determined in our sole discretion.
3.5 Copyrighted content
Copyrighted material must not be published via the Mobile Application and Services without the explicit permission of the copyright owner or a person explicitly authorized to give such permission by the copyright owner. Upon receipt of a claim for copyright infringement, or a notice of such violation, NHIA will immediately run full investigation. However, NHIA generally requires a court order from a court of competent jurisdiction, as determined by us in our sole discretion, to take down alleged infringing material from the Mobile Application and Services. NHIA may terminate the Service of Users with repeated copyright infringements. Further procedures may be carried out if necessary. NHIA will assume no liability to any User of the Mobile Application and Services for the removal of any such material. If you believe your copyright is being infringed by a person or persons using the Mobile Application and Services, please get in touch with NHIA to report copyright infringement.
4.0 Security
You take full responsibility for maintaining reasonable security precautions for your account. You are responsible for protecting and updating any login account provided to you for the Mobile Application and Services. You must protect the confidentiality of your login details, and you should change your password periodically.
4.1 Cookies
When using the Services, NHIA may collect certain information by automated means, such as cookies (small text files) and similar technologies, including mobile application identifiers, to improve your experience of the Services, increase security, measure use and effectiveness of the Services, identify and resolve issues. NHIA may also use cookies and other automated means for purposes such as management of our Services and other aspects of the Administration of NHIA business.
The information NHIA collects in this manner includes IP address, browser characteristics, device characteristics, operating system version, information on actions taken on our Services (such as usage, activity logs and click-throughs), and dates and times of visits. Log data is deleted periodically.
Your device may offer you control over the use of cookies or other technologies when you use the Services. For example, you may be able to set your device or browser to disable, clear, reset or block the use of cookies or similar technologies. Please note, however, that without cookies the NHIS App Services may not work properly, or you may not be able to use all their features.
By continuing to use our Services, you consent to the placement of cookies and other automated means in your browser and device in accordance with this Privacy Policy.
4.2 Your rights
Right of access If you are concerned or have any questions about your Personal Data, you have the right to request access to the Personal Data which NHIA holds or process about you. NHIA will then provide you with information about the data that are being processed and on the source of those data.
Right of rectification and right of erasure You have the right to request NHIA, free of charge to correct, erase or block any inaccuracies in your Personal Data if such Personal Data would be incomplete, inaccurate, or processed unlawfully.
Right to not be subject to automated individual decision making You have the right to request NHIA not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
Right to object to data processing Without prejudice to the termination provisions of the Terms of Use, you may withdraw at any time your consent to the processing of your Personal Data by NHIA by permanently removing the Application and notifying NHIA in writing thereof
via info@nhis.gov.gh. Upon receipt of this notification, NHIA shall promptly stop any processing of your Personal Data.
To exercise your abovementioned rights or any other questions concerning this Privacy Policy, please contact NHIA by e-mail or in writing on the address below. You should add a copy of your identity card or NHIS card or other proof of your identity to your request. NHIA will undertake the necessary action without undue delay or within 30 days.
4.3 Data retention and deletion
NHIA may retain information regarding you and your use of the Services, including Personal Data, for as long as reasonably needed to provide you with the Services and the uses described in this Privacy Policy.
Please note that NHIA retains your Personal Data even if you temporarily stop using the Application until you permanently delete the Application on your mobile device and notify NHIA thereof. Upon notification, NHIA may retain and continue to use and disclosure your Personal Data to Third Parties exclusively on a fully anonymized basis.
5.0 Enforcement
NHIA reserves our right to be the sole arbiter in determining the seriousness of each infringement and to immediately take corrective actions, including but not limited to:
Suspended and terminated User accounts due to violations will not be re-activated. A backup of User’s data may be requested; however, NHIA may not be able to provide you with one.
Nothing contained in this Policy shall be construed to limit our actions or remedies in any way with respect to any of the prohibited activities. In addition, NHIA always reserves all rights and remedies available to us with respect to such activities at law or in equity.
6.0 Reporting violations
If you have discovered and would like to report a violation of this Policy, please contact NHIA immediately. NHIA will investigate the situation and provide you with full assistance.
7.0 Changes and amendments
NHIA reserves the right to modify this Policy, or its terms related to the Mobile Application and Services at any time at our discretion. When this is done, NHIA will revise the updated date at the bottom of this page. NHIA may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.
An updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Mobile Application and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes.
8.0 Acceptance of this policy
You acknowledge that you have read this Policy and agree to all its terms and conditions. By accessing and using the Mobile Application and Services you agree to be bound by this Policy. If you do not agree to abide by the terms of this Policy, you are not authorized to access or use the Mobile Application and Services.
